1. Terms of Sale

  • Nothing on the website constitutes an offer, and Bimmer Blues Ltd reserves the right to withdraw or amend the website and any related materials at any time before accepting the buyer's order.
  • No material or information of any kind found on the website or communicated to the buyer, other than these terms, shall be considered part of the conditions governing the contract.
  • Bimmer Blues Ltd is not liable for any advice provided by its employees or agents regarding the application or use of the goods. Unless said advice is confirmed in writing and signed off by Bimmer Blues Ltd

2. Returns

  • Goods damaged in transit and any shortages must be reported as soon as possible after delivery, and within 14 days at the latest. 
  • The customer is responsible for the carriage costs to return correctly supplied goods. 
  • Additionally, any duties required by local customs authorities for the release of the goods must be paid by the customer. Failure to do so may result in the goods being returned to us or destroyed, and any associated return shipping, re-shipping, or restocking costs will be deducted from your refund.
  • All goods are sold in compliance with the Consumer Contracts Regulations 2013. If you wish to return a part more than 30 days after receipt, please contact us first, as such returns are at our discretion and may incur a 10% handling charge. No unwanted goods can be returned after 90 days.
  • If you need to return goods, please include a copy of your original invoice.
  • Returns are not accepted for tools, electrical goods after fitting (unless faulty), or ‘special order’ items.
  • Refunds are made in the currency you paid in. Exchange rate differences applied by your bank may result in a refund amount that is not exactly the same as the original payment.

3. Liability

3.1 Subject to the conditions outlined below, Bimmer Blues Ltd warrants that the goods will meet our specifications, or if no specifications exist, will be of standard industrial quality at the time of delivery. These goods will also be free from defects in materials and workmanship for a period of 12 months from the delivery date to the buyer.

3.2 Bimmer Blues Ltd shall not be liable for any defects in the goods that arise from:

3.2.1 Normal wear and tear, neglect, failure to follow Bimmer Blues Ltd instructions, misuse, or improper alteration or repair of the goods;

3.2.2 Non-payment of the total price for the goods by the due date.

3.3 The warranty in 3.1 does not extend to parts, materials, or equipment not manufactured by Bimmer Blues Ltd. In such cases, the buyer will only be entitled to any warranty or guarantee provided by the original manufacturer, which Bimmer Blues Ltd will, to the extent possible, assign to the buyer upon written request.

3.4 If a valid claim regarding a breach of the warranty in condition 3.1 is reported to Bimmer Blues Ltd within the specified warranty period, Bimmer Blues Ltd shall have the option to repair or replace the goods (or the relevant part) free of charge, or, at our discretion, refund the buyer the price of the goods (or a proportionate part of it).

4. Exemption

  • Except as explicitly stated in this contract and in accordance with the Unfair Contract Terms Act 1977, Bimmer Blues Ltd provides no warranties, whether express, implied, oral, or written, to the buyer for the following:
  • Any consequential or indirect loss or damage (including loss of profit), regardless of how it arises;
  • Any amounts exceeding the price of the goods related to the claim;
  • Any labor costs incurred by the buyer for the removal and reinstallation of the original or replacement goods;
  • Any competition parts after they have been installed.
  • Competition parts are warranted to be free from manufacturing defects and workmanship at the point of sale and should be thoroughly inspected before installation.
  • "Competition parts" refer to those parts that alter the performance of standard BMW production components.

5. The Website

  • Bimmer Blues Ltd holds the copyright to the website, and no part of it may be reproduced in any material form (including, but not limited to, photocopying or electronic storage) without the written consent of Jacob Flack & Bimmer Blues Ltd.
  • While all information, details, and illustrations on the website have been meticulously prepared to minimize errors, we do not guarantee the accuracy of this information. These details and illustrations do not constitute part of this contract. The seller is not liable for any loss or damage arising from errors, omissions, or typographical mistakes on the website.
  • All images are for reference purposes only unless specifically stated otherwise.

6. Severance

  • If any provision of these terms and conditions, or any part thereof, is deemed invalid or unenforceable by a competent authority, the validity of the remaining provisions and the unaffected portion of the provision in question will remain intact.
  • The contract shall be interpreted and governed by the laws of England, and both parties agree to submit to the jurisdiction of the English courts.
  • All images are for reference purposes only.
  • We are committed to continual improvement and reserve the right to make changes without prior notice.
